Welcome to SwiftConsign! These Terms of Service (“Terms”) govern your use of our website and services. By accessing or using SwiftConsign, you agree to comply with these Terms. If you do not agree, please do not use our services.
1. Services
SwiftConsign provides global consignment and delivery services, including real-time tracking, secure payments, and 24/7 support. These Terms apply to all users, whether you are sending or receiving shipments.
2. User Accounts
To book or track shipments, you may need to create an account. You agree to:
- Provide accurate, current, and complete information during signup.
- Maintain the security of your password and account credentials.
- Notify us immediately of any unauthorized use or security breach.
3. Booking & Payments
a) Booking: You agree to provide accurate details about your shipment (weight, dimensions, content) when booking. Misrepresentation may lead to additional charges or service refusal.
b) Payments: All prices are quoted in USD unless otherwise specified. Payment is due at the time of booking. We accept major credit cards, PayPal, and bank transfers. Cash on delivery is available in select regions.
4. Shipping & Delivery
SwiftConsign will make reasonable efforts to meet estimated delivery dates but does not guarantee delivery times. You understand and accept that external factors (weather, customs, local regulations) may cause delays.
We insure all shipments up to $1,000 by default. For higher-value goods, you may purchase additional insurance during booking. Claims must be submitted within 30 days of delivery or the estimated delivery date.
5. Tracking
Real-time tracking is provided via a unique tracking ID. You accept responsibility for keeping your tracking ID secure and understand that anyone with access to it can view shipment status.
6. Restrictions & Prohibited Items
You may not ship illegal, hazardous, or restricted items. Examples include (but are not limited to): explosives, flammable liquids, narcotics, cash, and perishable goods requiring special handling. Failure to comply may result in shipment refusal, fines, or legal action.
7. User Conduct
By using SwiftConsign, you agree not to:
- Use our services for unlawful or fraudulent purposes.
- Interfere with or disrupt the services or servers.
- Post or transmit harmful code (viruses, malware).
8. Intellectual Property
All content, trademarks, logos, and service marks displayed on SwiftConsign are owned by or licensed to us. You may not use, reproduce, or distribute any content without our prior written permission.
9. Termination
We reserve the right to suspend or terminate your account and access to our services at any time, without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.
10. Disclaimer of Warranties
SWIFTCONSIGN IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT WILL SWIFTCONSIGN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES. OUR MAXIMUM AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU ACTUALLY PAID TO US IN THE PAST 12 MONTHS.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the state and federal courts located in New York County, New York.
13. Changes to Terms
We may revise these Terms from time to time. The most current version will be posted at /terms. Your continued use after changes indicates your acceptance of the new Terms.
